Terms & Conditions

The domain of the website belongs to BNPERF, LDA., a legal person 516007866, which is responsible for its operation and operation management.

The use of the website by third parties implies, from now on, the acceptance of these Terms and Conditions (“TC”) by its Users.

  1. Access to the Site

BNPERF, Lda., as the owner of the Website, may, at any time, deny its access to third parties, namely for repair or maintenance purposes. In addition, BNPERF, LDA will be responsible for it. the right to terminate it at any time in the event of any circumstance that justifies it.

  1. Intellectual Property Rights
    1. They belong to BNPERF, LDA. the copyright on all texts, drawings, images, graphics and other content that are displayed on the website.
    2. BNPERF is authorized by its authors to disseminate texts, drawings, images, graphics and other content that do not belong to it.
    3. Users are not allowed to reproduce, copy, alter, sell or use these elements without obtaining prior written permission from BNPERF, LDA.
  2. Privacy and processing of personal data
    1. For the purpose of creating an account for Users of the Website, they will always be asked to provide an email address and an access password. It will be up to the User to keep this data in a safe place and change it if there is evidence of misuse of the account by unauthorized third parties.
    2. Likewise, if the data or personal information provided by Users changes, it will be their responsibility to update those elements.
    3. Notwithstanding, the privacy of the Users of the Site is a special concern for BNPERF, LDA. In this sense, we have approved a Privacy Policy which defines the general principles applicable to the collection and processing of personal data, to which we will strictly comply.
    4. Our Privacy Policy is supplemented by our Cookie Policy.

A BNPERF, LDA. reserves the right to make any changes that may be necessary to these TC. Whenever this happens, they will be published on the Website, so it is advisable that Users of the Website consult them regularly.

General Conditions of Sale – GCS

The purchase of products is subject to Portuguese law and is regulated by the following conditions:

  1. Purchase
    • The Products are presented on the Website with a description that allows the Buyer to know their essential characteristics and their price.
    • The Buyer selects the Product(s) they wish to purchase.
    • The Purchaser confirms his/her choice of Product(s) and acknowledges and accepts these T&Cs by a click of validation.
    • At that time, the amount of the order will be debited, except in cases where the payment has been made previously.
    • BNPERF, Lda., undertakes to confirm and/or inform the availability of the Product(s) ordered by the Buyer within a maximum period of 48 hours from the receipt of the information as provided for in paragraph 4) above.
    • Once the order has been validated or invalidated, a communication is sent to the Buyer (e-mail, SMS or other) to inform them of the shipment or cancellation of the order.
    • In case of total or partial confirmation of the order, the resolutive condition that is part of the purchase and sale contract entered into between the Buyer and BNPERF, LDA. this is not the case, thus assuming BNPERF, LDA. the final commitment to ship the order on time.
    • In the event of confirmation of the availability of all or part of the Products ordered by the Purchaser, such Products are shipped by BNPERF, LDA.
    • The product(s) shall be deemed to have been received on the date on which the Purchaser or a third party, other than the carrier, acquires physical possession of the product(s) or, in the case of several goods ordered by the Purchaser in a single order and delivered separately, on the date on which the Purchaser or a third party, other than the carrier, acquires physical possession of the last goods.
  2. Price & Payment
    • The purchase price of the product is determined by BNPERF, LDA.
    • For shipments within the European Union, the price indicated includes all taxes, fees and shipping costs in the description sheet.
    • For shipments outside the European Union, taxes, fees and shipping cost in the description sheet, orders may be subject to import taxes and duties that are applied when the order arrives at that destination. The customer will be responsible for paying any import taxes and duties not included. Please contact your local customs office for more information and a “landed cost estimate” before placing your order.
    • All orders are charged in Euros (EUR).
    • The order can be paid by one of the following means:
      • VISA or Mastercard credit cards

  1. Right of withdrawal
    • Under the terms of the legislation in force, the Buyer has a period of 14 (fourteen) days from the receipt of the Product(s) ordered to exercise, with BNPERF, Lda., its right of free resolution without payment of compensation and without the need to indicate the reason.
    • The right of free withdrawal must always be exercised by the Buyer, within the legal period of 14 (fourteen) days from the receipt of the Product(s) ordered and in writing, expressly declaring the unequivocal termination of the contract, to the info@bnperf.com email or by post.
    • In the event of exercising the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and the shipping costs will be refunded. Return shipping costs are borne by the Buyer.
    • The Product(s) must be returned in the original and complete condition (packaging, accessories, instruction manual, etc.) packed in the same way as in the shipment, within 14 (fourteen) days from the date of communication of point 2 (two) above to the head office of BNPERF, Lda. in Portugal.
    • It is the responsibility of the Buyer to prove that he/she has exercised the right of free withdrawal within the legally established period and the timely return of the Product(s).
    • If you terminate the contract under these terms, you have the right to be reimbursed for all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method offered by us), within 14 days from the date on which you inform us of your decision to withdraw from the contract. However, BNPERF, Lda. has the right, except in cases where it offers to collect the Product(s), to withhold your refund until you receive the Product(s) back.
    • The contractual right to return the products shall apply only to products that can be returned in the same condition in which the Purchaser received them, so upon receipt of the Product(s), they will be examined to verify that they are in the same condition as the Purchaser received them. No refund will be made if the Product(s) has been used or damaged, so please be careful with the Product(s).
    • The refund will be made using the same means of payment used in the initial transaction, unless otherwise expressly agreed between the parties.
    • Under the applicable legal terms, the right of free resolution cannot be exercised in relation to any product that has been removed from the guarantee and/or inviolability seal, or that has been tampered with.
    • The exercise of the right of free resolution is without prejudice to the Buyer’s right to inspect, with due care, the nature, characteristics and functioning of the goods.
    • The Buyer may be held liable for the depreciation of the property if the manipulation carried out to inspect the nature, characteristics and functioning of that asset exceeds the manipulation that is usually allowed in a commercial establishment.
    • The Buyer may also be held responsible for any decrease in the value of the products resulting from the delivery of the same to BNPERF, Lda.
  2. Jurisdiction to Settle Consumer Disputes
    • In the event of a consumer dispute, defined in accordance with the provisions of Law No. 144/2015, of 8 September, the consumer may resort to the competent alternative dispute resolution entity: Automobile Sector Arbitration Centre – https://www.arbitragemauto.pt/.
    • Without prejudice to the laws, statutes and regulations to which alternative dispute resolution entities are bound, the consumer may opt for the European online dispute resolution platform available at https://webgate.ec.europa.eu/odr, the alternative dispute resolution entity for consumer disputes at the place of his domicile or the alternative dispute resolution entity with specialised jurisdiction, if it exists for the sector in question. You can consult the updated list of all alternative consumption resolution entities available in www.consumidor.pt.
  3. Non-conforming product/ Damaged
    • It is necessary to return it to BNPERF, Lda. of the non-conforming/damaged product.
      BNPERF, Lda. Send, if it is in stock, a product with equivalent characteristics and price. If this is not possible, the value of the order will be refunded to the Buyer.
  4. Misidentified product
    • If the error is the responsibility of BNPERF, Lda., the procedure is the same as for non-conforming product, i.e., the product must be returned to BNPERF, Lda.and if there is a product of equivalent characteristics and price in stock, it will be sent to the Buyer.
    • In the case of products that have the same reference and are still not compatible, BNPERF, Lda. you will not be responsible for this incompatibility, so the Buyer should always check that the product they are buying is suitable for their vehicle.
  5. Warranty
  6. BNPERF, Lda. It offers a warranty on all its products, as long as the assembly of the parts is carried out in workshops regulated by law.
  7. The warranty period is detailed on each of the products on their respective product page.
  8. If failures or errors occur during the warranty period, the customer must notify and deliver the goods subject to warranty to BNPERF, Lda. so that they can be assessed, repaired and, where appropriate, returned.
  9. The following cases are excluded from this warranty:
    1. Consumables & Wear Parts
    2. Shipping damage not reported within 24 hours of receipt of the parts
  10. Other Warranty Considerations
  11. The products marketed by BNPERF, Lda. They are duly identified by their own marks and engravings, for the correct identification of their origin, in case they have to be returned. Such marks and engravings may not be tampered with, otherwise the items will lose their warranty.
  12. BNPERF, Lda. It will not be responsible for warranties and/or returns in cases where the parts require special installation and/or adaptations. For example, parts that require to be coded from the moment they are handled lose their warranty. The customer should always take this fact into account before making their purchase.
  13. In all cases, the labor and use of replacement vehicles are absolutely excluded from the warranty of the parts sold by BNPERF, Lda.
  14. The invoice is your proof for any claim, so this document must be kept by the customer to exercise their rights.
  15. Governing Law and Jurisdiction

These General Conditions of Use are subject to Portuguese Law and for all issues arising therefrom, the parties elect the jurisdiction of the District of Porto.
